All About Divorce In Iredell County And North Carolina

Divorce laws and procedures can vary widely, so it’s important to understand the specific requirements and steps for your state. Here are two unique rules in our state to remember:

  • No-fault divorce: North Carolina allows for no-fault divorce, which means that neither spouse has to prove marital misconduct to file for divorce.
  • Separation requirement: The spouses must separate legally for at least one year continuously and without cohabitation before filing for divorce.

When you are ready to file for divorce, you file a Complaint for Absolute Divorce with the court in the jurisdiction where you or your spouse reside. Then, you can serve your spouse with the papers yourself, through certified mail, through the sheriff’s office or with a process server. Your spouse has 30 days to respond. Then, you are closer to finalizing your divorce. The timeline for a divorce varies widely. Some uncontested divorces may take a few weeks. Hotly contested divorces may take months to years.
